These Terms of Service ("Terms") govern your access to and use of our iOS mobile application EnglishPod (the "App"), including any content, functionality, products, and services offered on or through the App.
Please read these Terms carefully before you start using the App. By using the App or by clicking to accept these Terms when prompted, you accept and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.
The App allows you to purchase access to premium content and features through in-app purchases. All in-app purchase transactions are processed by the Apple App Store's payment system, not by us. We are not responsible for any issues relating to processing of payments, refunds, etc. Please refer to the Apple App Store's terms and policies with regard to any purchases.
We do unfortunately not provide refunds for any in-app purchases. Please make purchase decisions carefully as all purchases are final. Contact Apple support for any issues with payments or billing.
The App does not allow users to submit or share any content. If we allow submission of user content in the future, we will update these Terms with additional guidelines for user content.
You agree not to misuse the App or assist anyone else in doing so. This includes: - Violating any applicable laws or regulations - Sharing purchased in-app content with others - Distributing malicious content through the App - Attempting to interfere with the App's functionality
The App and all content, features, and functionality on the App are owned by us and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You are permitted to use the App as expressly authorized by these Terms. You may not copy, modify, distribute, sell, or lease any part of the App.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY ARISING FROM YOUR USE OF THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR IN-APP PURCHASES, IF ANY.
You agree to hold harmless, indemnify and defend us from any claims, damages, liabilities, costs, and expenses arising from your misuse of the App or violation of these Terms.
We may occasionally update these Terms. When we do, we will also revise the "Last Updated" date below. Your continued use of the App constitutes agreement to the updated Terms.
